SOBRE ESCOLAS, TRIBUNAIS E JUSTIÇA RESTAURATIVA: ONDE COMEÇAMOS A RESTAURAR?

Abstract

Abstract: This paper aims to investigate restore justice regarding courts and schools, through a historical analysis of Restore Justice settling in the world and in Brazil. We also object to check the scientific studies published in the last few years about Conflict Mediation in school environments so to map different sectors initiatives dealing with school violence issues. It is a qualitative-quantitative, exploratory and bibliographic-document research (regarding scientific studies worldwide and nationwide and Brazilian reports with regards to Restore Justice. It also carries out a literature review on national studies on Mediation and Conflict Resolution proposals in school environment. Amongst the conclusions, it was noted that Restore Justice is a viable system and fits Brazilian legal order, it also presents a potential to solve in adequate and fast ways diverse sorts of conflicts. Restore Justice could be applied in several areas in and out judicial system. In school environment, it is noted that violent actions do not occur in isolated forms (within a certain school walls), but in various school environments and locations. Conflict Mediation present itself as a viable strategy to reach harmony with regards to school violence. We also observed the need for investment in training people to work in this environment as social mediators.
