A VOZ DISSIDENTE CONTRA A SEGREGAÇÃO RACIAL: O VOTO DO JUSTICE HARLAN NO CASO PLESSY V. FERGUSON MARCADO NA HISTÓRIA DA SUPREMA CORTE NORTE-AMERICANA

Resumo

Plessy v. Ferguson foi uma decisão histórica da Suprema Corte dos Estados Unidos da América que firmou a constitucionalidade das leis de segregação racial para estabelecimentos públicos, desde que os lugares segregados fossem iguais em qualidade. Tal instituto passou a ser conhecido no mundo jurídico como a doutrina do separate but equal. A decisão legitimou as muitas leis estaduais que restabeleceram a segregação racial presente nos estados sulistas do país antes da Era da Reconstrução (1865-1877). Visitar a decisão proferida pela Suprema Corte dos Estados Unidos é o objetivo do presente trabalho, ultrapassando o delineamento histórico da segregação racial no contexto norte-americano, o trâmite processual da demanda, o julgamento e, em evidência, o voto divergente proferido pelo Justice John Marshall Harlan.
