POSITIVISMO JURÍDICO E HERMENÊUTICA CONSTITUCIONAL: DESAFIOS E PERSPECTIVAS NA INTERPRETAÇÃO DO DIREITO
Abstract
This study addresses the interaction between legal positivism and constitutional hermeneutics as fundamental theoretical approaches in the interpretation of contemporary law. This research used a critical review of the literature, through the analysis of classic and current literature, using the comparative method. The results reveal that while legal positivism offers a stable and predictable normative structure that does not fully respond to constant social changes, constitutional hermeneutics enriches this structure by considering the fundamental principles of justice and human rights. However, the coexistence of these approaches also generates challenges, such as possible subjectivity in judicial interpretation and the need
to guarantee normative coherence with the Constitution. It is concluded that the complementarity between legal positivism and constitutional hermeneutics can strengthen the interpretation of law, promoting a fairer and more effective application of legal norms.
