ENCARCERAMENTO E MIGRAÇÕES INFANTIS NO CANADÁ: IMPLICAÇÕES PARA OS DIREITOS HUMANOS DAS CRIANÇAS MIGRANTES (2010-2016)

Resumo

Nos últimos anos, o Canadá manteve centenas de crianças migrantes em situação de detenção por tempo indeterminado para fins de controle da imigração; inclusive, algumas delas foram e ainda são mantidas em confinamento solitário. As práticas atuais do Canadá relacionadas à detenção de crianças em virtude de seu status migratório violam as obrigações legais internacionais do país, principalmente aquelas inscritas na Convenção da ONU sobre os Direitos da Criança, da qual o Estado canadense é parte. O objetivo geral do artigo é identificar se existiram e quais foram as violações aos direitos humanos das crianças migrantes aprisionadas a partir de suas experiências nos centros de detenção no Canadá no período de 2010 a 2016. A abordagem do artigo é essencialmente qualitativa, o método utilizado para a construção da pesquisa fora o descritivo-explicativo, de um ponto de vista indutivista, com auxílio de fontes bibliográficas e documentais.
